Website Terms of Use

Version 1.0

These Website Terms of Use describe use of the public website operated by Appalachian Integrity LLC, a Virginia limited liability company. They do not replace an accepted software agreement or a separately signed professional-services agreement.

Public information and examples require independent verification before use. Visiting the website alone does not establish your assent to a separate agreement.

The Client and Contractor Portal, Weldbook AI, Pipe ISO Drafter AI, Tank & PV Drafter AI, API Report Builder and internal tools have the applicable agreements presented for their use. Those agreements govern their respective applications and purchases.

Article 1. Informational Purpose Only

  1. Descriptions, technical explanations, frequently asked questions, examples and illustrations are general information. Product descriptions and express purchase commitments remain subject to applicable law.
  2. General information is not a substitute for a qualified person's judgment concerning the actual equipment, evidence, governing code and inspection scope.
  3. The website and software do not provide professional engineering services. Inspection credentials do not confer a professional-engineering licence. Obtain a licensed engineer when required by Virginia law or the jurisdiction governing the work.
  4. Confirm every code reference, edition, unit, material, temperature, assumption and acceptance criterion against the applicable authorized source. The website does not supply a licence to reproduce third-party standards.

Article 2. Automated Answers and Artificial Intelligence

Automated assistance, including OpenAI-powered features identified in the apps, can help with wording, extraction and formatting. Its limits include:

  1. AI can omit, misread or invent information; calculations also depend on correct inputs and applicable formulas. Missing information is unknown, not zero or acceptable.
  2. Text suggestions, imported historical facts, acronym expansions, custom layouts, drawings and calculations do not establish that the Company inspected equipment, reviewed the work, verified measurements or certified compliance.
  3. Check source records and every finished page before use. Historical readings are not current readings. A comparison does not prove an omitted finding was repaired. A saved layout or paid output does not approve a later report.
  4. Features may send selected text, documents, images and relevant context to the identified provider. Follow the Privacy Policy and facility restrictions, and submit only information you are authorized to provide for that processing.

Article 3. No Professional Relationship; Enquiries and Submissions

  1. Visiting, sending an inquiry or submitting an intake does not engage the Company for professional services. Those services require a separate written agreement identifying their scope.
  2. A software purchase is governed by its displayed order and applicable accepted terms. Inspection-service estimates remain subject to a written proposal. Prices and mandatory charges must be disclosed before a purchase commitment.
  3. Submit only the information needed for your request through an appropriate authorized channel. Public forms are not suitable for passwords or unnecessarily sensitive material. Submitted information remains subject to the Privacy Policy and applicable duties.
  4. You must have permission to submit client records, photographs, logos, templates and other third-party material.
  5. We may use voluntarily supplied product feedback to improve the service, without acquiring your rights in confidential inspection records or permission to publish them.

Article 4. Acceptable Use

You shall not:

  1. Use the Site in violation of any applicable law or regulation;
  2. Probe, scan, degrade, overload, or attempt to gain unauthorized access to the Site, its servers, or any account or system connected to it;
  3. Introduce malicious code, or use any robot, spider, scraper, or automated means to access the Site except as a well-behaved search-engine crawler;
  4. Harvest or collect any personal information from the Site;
  5. Copy, reproduce, republish, frame, or distribute any part of the Site except as permitted in Article 5; or
  6. Impersonate any person, or misrepresent your affiliation with any person or organization.

Article 5. Intellectual Property

  1. The Site and all of its content, design, text, graphics, logos, marks, photographs, and software are owned by the Company or its licensors and are protected by copyright, trademark, and other laws.
  2. You may view the Site and print or download individual pages for your own internal, non-commercial reference, provided you do not remove any proprietary notice.
  3. All other use, including reproduction, modification, distribution, transmission, republication, framing, or use of the Company’s name, logo, or marks, requires the Company’s prior written consent.
  4. Third-party names, marks, code designations, and standard designations referred to on the Site are the property of their respective owners and are used for identification only. Their use does not imply any affiliation with, endorsement by, or accreditation from their owners.

Article 6. Third-Party Links and Resources

Links identify outside resources. Their operators control their content, availability and privacy practices. Review those practices before submitting information. A link does not establish endorsement or certification; this description does not excuse the Company's own legally actionable conduct.

Article 7. Disclaimer of Warranties

THE PUBLIC SITE AND GENERAL AUTOMATED INFORMATION ARE PROVIDED AS IS AND AS AVAILABLE. TO THE EXTENT LAWFUL, THE COMPANY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Errors and interruptions can occur. This qualification does not negate an express purchase commitment, a legally actionable representation, a nonwaivable warranty or remedy, or responsibility under a separate professional-services agreement.

Article 8. Limitation of Liability

Information on this site assists documentation and does not determine equipment safety or replace your inspection decisions. This allocation does not release the Company from its own legally actionable conduct.

No financial liability cap or exclusion of consequential damages is imposed merely by visiting this public site. A validly accepted software agreement or separately signed services agreement may address its own subject matter.

No provision here limits liability for death or personal injury, fraud, willful or wanton misconduct, gross negligence, or rights and remedies that cannot lawfully be limited.

Article 9. Indemnification

Merely visiting or using the public site creates no contractual duty to defend or indemnify the Company. Responsibility for unlawful conduct remains governed by applicable law and any validly accepted agreement covering the conduct.

Article 10. Privacy

The Company’s collection and use of information through the Site is described in the Privacy Policy, which is incorporated into these Terms by reference.

Article 11. Changes to the Site and to these Terms

  1. We may update public information and features, subject to express commitments and applicable law.
  2. The version and adoption status of these terms are displayed with the document.
  3. A material software amendment requires the applicable advance notice and affirmative acceptance; continued browsing alone does not supply that acceptance. Changes do not retroactively alter accrued claims or completed purchases.
  4. Earlier versions remain available for reference.

Article 12. General Provisions

  1. Applicable law. Virginia law applies where legally applicable. These terms do not displace another jurisdiction's nonwaivable protections.
  2. Venue. Jurisdiction and venue follow applicable law and any enforceable agreement actually accepted for the relevant transaction; viewing this page alone is not consent to exclusive venue.
  3. Time limits. Applicable statutory limitation periods govern; these website terms do not shorten them.
  4. Jury and dispute rights. These website terms impose no jury-trial, arbitration or class-action waiver.
  5. Severability. If a provision is unenforceable, the remaining provisions apply only to the extent permitted by law.
  6. No waiver. Delay in asserting a right does not alone waive it.
  7. Separate agreements. Validly accepted software orders and signed professional-services agreements govern their respective transactions.
  8. Interpretation. Headings aid reading and do not expand a provision.
  9. Contact. john@appalachianintegrity.com · (540) 524-2290.

Article 13. Acknowledgment

Review technical information against the actual evidence and governing requirements. A logo, clean file, payment or automated result does not establish professional review or equipment safety. These responsibilities do not waive your nonwaivable rights.
